SPECIAL TOWN MEETING

February 15, 2005


Bristol, ss.

To either of the Constables of the Town of Raynham, in the County of Bristol, GREETING.

    IN THE NAME OF THE COMMONWEALTH OF MASSACHUSETTS, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Middle School Auditorium in said Raynham, on the 15th day of February, at 7:00 in the evening, then and there to act on the following Articles: --


ARTICLE 1:  To see if the Town will vote to transfer from free cash the amount of $120,000 to the stabilization account created for the purpose of purchasing a new or used ladder truck for the Fire Department, or take any action relative thereto.  
Note:  Money from this account will be combined with money from other sources to purchase the ladder truck.
ARTICLE 2: To see if the Town will vote to transfer from free cash the sum of $4,000 for maintenance of the Sullivan School and the North School, or take any action relative thereto.
ARTICLE 3:  To see if the Town will vote to transfer from the Town Engineering Account the sum of $5,000 for the payment of bills incurred during a previous fiscal year that remain unpaid, or take any action relative thereto.

ARTICLE 4:      To see if the Town will vote to amend the Town of Raynham General By-laws, Section 2/33, Snow and Ice Removal, by adding the following language at the end of said article, or take any action relative thereto:  The Town will, however, reimburse a resident up to $25.00 in the event that the resident’s mailbox is damaged or destroyed during the Town’s snow removal operations.
Note:   The present By-law reads:  The Town is not responsible for damage incurred to mail boxes, fences, trees, shrubs and/or other obstructions located within the Town layout, resulting from snow removal.

ARTICLE 5:  To see if the Town will vote to transfer from Free Cash the following amounts to the specified accounts in settlement of a Collective Bargaining Agreement for FY 05, or take any action relative thereto.

ARTICLE 6:  To see if the Town will vote to transfer the sum of $5,500 from the account Cemetery- Sale of Lots for the purpose of improving the roads and infrastructure of town cemeteries, or take any action relative thereto.

ARTICLE 7:   To see if the Town will vote to transfer the sum of $18,000 from the Park and Recreation Revolving Account to the Borden Colony Account for the surveying, engineering and architectural costs pertaining to the construction of a new storage garage for the Park and Recreation Department, or take any action relative thereto.

ARTICLE 8:  To see if the Town will vote to transfer from free cash the sum of $11,000 to the Conservation Commission Salary Account to pay for additional costs related to the retirement of the Conservation Agent and the hiring of a new agent, or take any action relative thereto.

ARTICLE 9. To see if the Town will vote to transfer from free cash the sum of $6,228 to the Police Department Salary Account to pay for increases in the Career Incentive payments in accordance with the union contract, or take any action relative thereto.

ARTICLE 10: To see if the Town will vote to transfer from free cash the sum of $10,000 for the second year of a major upgrade the police department main computer system (hardware and software) for the Police Department, or take any action relative thereto.

ARTICLE 11: To see if the Town will vote to transfer free cash the sum of $12,000 to purchase Non- Lethal Weapons (Tasers), or take any action relative thereto.

ARTICLE 12. To see if the Town will vote to authorize the Board of Selectmen to accept as a gift, purchase or take by eminent domain from Paramount Development Associates, Inc. or the present owner of the premises, a perpetual non-exclusive drainage easement in the below described premises for the public purpose of alleviating street flooding, or take any other action relative thereto:

Beginning at the most southwesterly corner of said easement on the northerly sideline of Hill Street, which point is 108.32’ along Hill Street from the most southwesterly corner of a parcel of land shown as “Lot 7” on the below described Plan, thence running:

N 32º 21’ 23” E         48.86 feet to a point, thence turning and running;

S 57º 38’ 37” E                 20 feet to a point, thence turning and running;

S 32º 21’ 23” W                 28.36 feet to a point in the northerly sideline of Hill Street,                                         thence turning and running;

S 76º 39’ 12” W         28.64 feet along the northerly sideline of Hill Street to the                                   point of beginning.

Said easement being 772 square feet more or less, according to the Plan.

The easement contains 772 + square feet within the land area shown as “20’ DRAINAGE EASEMENT 772 + SF” on a plan entitled “EASEMENT PLAN LOT 7, RAYNHAM WOODS COMMERCE CENTER, ROUTE 44, RAYNHAM, MA (BRISTOL COUNTY)  DATE:  JULY 30, 2002, SCALE 1” = 30’”, a copy of which is located in the office of the Town of Raynham Board of Selectmen.  


     And you are directed to serve this Warrant, by posting up attested copies thereof at the seven (7) places directed by vote of the Town, in said Town, fourteen (14) days before the time of holding said meeting.


     HEREOF FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.
