TOWN OF RAYNHAM

THE COMMONWEALTH OF MASSACHUSETTS

SPECIAL TOWN MEETING

May 16, 2005


Bristol, ss.

To either of the Constables of the Town of Raynham, in the County of Bristol, GREETING.

    IN THE NAME OF THE COMMONWEALTH OF MASSACHUSETTS, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Middle School Auditorium in said Raynham, on the 16th day of May, at 6:45 in the evening, then and there to act on the following Articles: --

ARTICLE 1.  To see if the Town will vote to transfer the sum of $5,000 from the Overlay Surplus account for use by the 275th Anniversary Committee for expenses related to
preparation of the Town’s 275th Anniversary; or take any action relative thereto.

ARTICLE 2.  To see if the Town will vote to authorize the Board of Selectmen to accept as a gift a parcel of land on Carver Street designated as Assessor’s Map 4, Lot 165, from Jeannette Pouliot or current owner; or take any action relative thereto.  
Note:  The lot is recorded at the Bristol County Northern District Registry of Deeds in Book 1507, Page 1165.

ARTICLE 3.  To see if the Town will vote to transfer the balance of the Landfill budget
at the end of FY 2005 to the Special Landfill account to offset the cost of operating the Town’s solid waste and recycling facility and maintaining landfill infrastructure as result of closure; or take any action relative thereto. (Submitted by the Highway Department)
ARTICLE 4.  To see if the Town will vote to transfer the balance of the Highway
Department operating budget at the end of FY 2005 to the Snow and Ice Account to offset the cost of operating the snow and ice program; or take any action relative thereto.  (Submitted by the Highway Department)

ARTICLE 5.  To see if the Town will vote to appropriate the sum of $3,000,000 on or
after July 1, 2005 to renovate the Sullivan School for use as Town Offices, including architectural, engineering, site work and construction costs related thereto and to authorize the Treasurer, with approval of the Selectmen, to raise said amount by borrowing for a term up to twenty years pursuant to M.G.L. Chapter 44 as amended; or take any action relative thereto. (Submitted by Citizens’ Petition)

ARTICLE 6.  To see if the Town will vote to authorize the Fire Department to acquire an aerial platform ladder truck by lease-purchase in accordance with MGL Chapter 40, Section 4 on terms acceptable to the Finance Committee and Board of Selectmen with the amount to be financed not to exceed $375,000; or take any action relative thereto.
Note:  Money is to be combined with other funding sources.  The breakdown of costs is as follows:  ladder truck - $654,464, equipment costs - $48,538 and renovation costs - $20,000

ARTICLE 7.   To see if the Town will vote to approve the Tax Increment Financing Agreement between the Town and M.T. Lot, LLC and Mastria Subaru of Raynham, substantially in the form as is on file with the Town Clerk (the “TIF Agreement”), pursuant to Massachusetts General Laws, Chapter 40, Section 59, as an Economic Opportunity Area (“M.T. Lot, LLC and Mastria Subaru of Raynham, Economic Opportunity Area”) and to authorize the Board of Selectmen to submit an Economic Opportunity Area Application, Tax Increment Financing Plan, and Certified Project Application to the Massachusetts Economic Assistance Coordinating Council all relating to the project located on a portion of a parcel identified as Assessor’s Map 15, Lot 176-4N.  Said Agreement shall be considered in return for locating said business in Town and a subsequent increase in the assessed value of the property based on improvements to said property.  To take such other actions as may be necessary to obtain approval of the Certified Project Application, the Economic Opportunity Area, the Tax Increment Financing Plan, and TIF Zone and to implement the TIF Agreement; or take any action relative thereto.

ARTICLE 8.  To see if the Town will vote to transfer the sum of $15,000 from the Fire Department Salaries Account to the Fire Department Wage Account; or take any action relative thereto.

ARTICLE 9.    To see if the Town will vote to raise and appropriate or transfer the sum of  $______to the Fire Department Wage Account; or take any action relative thereto.

ARTICLE 10.   To see if the town will vote to amend Article 25 of the Special Town Meeting of November 15, 2004 by adding the words “to the Police Expense Account” after the word $2,500.00 and before the words “to maintain the Police Department mobile data terminals (2)”; or take any action relative thereto.

ARTICLE 11. To see if the Town will vote to transfer the sum of $11,000 from the Overlay Surplus account to the Health Insurance account, or take any action relative thereto.

ARTICLE 12: To see if the Town will vote to transfer the sum of $35,000 from Sewer Enterprise retained earnings to install a Muffin Monster Grinder at the Route 44 Pumping Station; or take any action relative thereto.

    And you are directed to serve this Warrant, by posting up attested copies thereof at the seven (7) places directed by vote of the Town, in said Town, fourteen (14) days before the time of holding said meeting.

     HEREOF FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.
