Special Town Meeting Warrant (2nd of 2) June 26, 2006 @ the Middle School

TOWN OF RAYNHAM

THE COMMONWEALTH OF MASSACHUSETTS

SPECIAL TOWN MEETING

June 26, 2006


Bristol, ss.

To either of the Constables of the Town of Raynham, in the County of Bristol, GREETING.

    IN THE NAME OF THE COMMONWEALTH OF MASSACHUSETTS, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Middle School Auditorium in said Raynham, on the 26th day of June, at 6:45 in the evening, then and there to act on the following Articles:--

ARTICLE 1.  To see if the Town will vote to transfer the balance of the Landfill budget at the end of FY2006 to the Special Landfill account to offset the cost of operating the Town’s solid waste and recycling facility and maintaining landfill infrastructure as result of closure; or take any action relative thereto.  (Submitted by the Highway Department)

ARTICLE 2. To see if the Town will vote to transfer the balance of the Highway Department operations budget at the end of FY2006 to the Snow and Ice account to offset the cost of operating the snow and ice program; or take any action relative thereto.  (Submitted by the Highway Department)

ARTICLE 3.  To see if the Town will vote to transfer from Free Cash the sum of $16,338 to pay for necessary electrical work associated with the installation of a new generator for the Police Station/Fire Station/Town Offices building, or take any action relative thereto.

ARTICLE 4. To see if the Town will vote to transfer the sum of $41,020 from Overlay Surplus for infrastructure improvements to Carver Street, King Street and Locust Street, or take any action relative thereto.

ARTICLE 5. To see if the Town will vote to transfer from Free Cash the sum of $26,500 for Legal Services including Labor Counsel and stenographic services related to certain Civil Service hearings, Arbitration hearings and/or Mediation sessions, or take any action relative thereto.

ARTICLE 6. To see if the Town will vote to transfer from Free Cash the sum of $7,500 to pay a settlement amount in the case of Westcoat v. Town of Raynham, Bristol Superior Court C.A. No.: BRCV 2005-01087-B, or take any action relative thereto.

ARTICLE 7. To see if the Town will vote to transfer the sum of $12,390.00 from the Fire Department Salaries Account to the Fire Department Wage Account; or take any action relative thereto.

ARTICLE 8. To see if the Town will vote to transfer from the General Stabilization Account the sum of $25,000.00 to the Fire Department Wage Account; or take any action relative thereto. (This is due to 2 Firefighters that were injured during the year, one of which was extended over a period of 9 months and incentive pay due to restructuring of the accounting process).

ARTICLE 9. To see if the Town will vote to transfer from the General Stabilization Account the sum of            to the Fire Department Expense Account; or take any action relative thereto. (This was due to unforeseen major expenses to apparatus that occurred this year, that were not appropriated for FY 2006).

ARTICLE 10.  To see if the Town will vote to amend the Town of Raynham General By-laws Section 1/2.1 - Cemetery Commission by deleting the following strikethrough language and adding the bold language, or take any action relative thereto.

Section 1 /2.1  Cemetery Commission

A Cemetery Commission of three shall be elected, one for one year, one for two years, and one for three years, and thereafter one for three years, to serve without pay. They shall organize within seven days from election and choose a Chairman and a Secretary. No member of the Commission shall hold any other Elective or Appointed Office. No member of the Commission shall be appointed to perform any duties for the Cemetery Department receiving pay. The Commission shall draw up a set of rules and regulations governing the management of Cemeteries, that will conform with Chapter 114, Sections 22-26 of the general laws and file a copy with the Town Clerk. The Commission may amend or add to rules and regulations at any time by a majority vote and shall notify the Town Clerk of their act.

ARTICLE 11.  To see if the Town will vote to approve the Tax Increment Financing Agreement between the Town of Raynham and Silvia & Quinn, P.C., 180 Paramount Drive, Raynham, MA 02767, substantially in the form as is on file with the Town Clerk (the “TIF Agreement”), pursuant to Massachusetts General Laws, Chapter 40, Section 59, as an Economic Opportunity Area (“Silvia & Quinn, P.C., Economic Opportunity Area”) and to authorize the Board of Selectmen to submit an Economic Opportunity Area Application, Tax Increment Financing Plan, and Certified Project Application to the Massachusetts Economic Assistance Coordinating Council all relating to the project located on a parcel of land identified as Assessor’s Map 15, Lot 176-2G and 180 Paramount Drive, Raynham, MA 02767.  Said Agreement shall be considered in return for locating said business in Town and a subsequent increase in the assessed value of the property based on improvements to said property.  To take such other actions as may be necessary to obtain approval of the Certified Project Application, the Economic Opportunity Area, the Tax Increment Financing Plan, and TIF Zone and to implement the TIF Agreement; or take any action relative thereto.


     And you are directed to serve this Warrant, by posting up attested copies thereof at the seven (7) places directed by vote of the Town, in said Town, fourteen (14) days before the time of holding said meeting.

     HEREOF FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.
