SPECIAL TOWN MEETING

January 29, 2007


Bristol, ss.

To either of the Constables of the Town of Raynham, in the County of Bristol, GREETING.

    IN THE NAME OF THE COMMONWEALTH OF MASSACHUSETTS, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Middle School Auditorium in said Raynham, on the 29th day of January, at 7:00 in the evening, then and there to act on the following Articles: --

Article 1.  To see if the Town will vote to raise and appropriate the sum of $19,115 to pay retroactive costs for FY 06 pursuant to a new Collective Bargaining Agreement for the Police Communication Clerks; or take any action relative thereto.

Article 2.  To see if the Town will vote to raise and appropriate the sum of $28,040 to the Police Communications Account to pay the costs of a Collective Bargaining Agreement; or take any action relative thereto.

Article 3.  To see if the Town will vote to raise and appropriate the sum of $60,628 to Fire Department Salaries; or take any action relative thereto. (Due to settlement of Contract Negotiations)

Article 4.  To see if the Town will vote to raise and appropriate the sum of $32,576 to Fire Department Wages; or take any actions relative thereto. (Due to settlement of Contract Negotiations)

Article 5.  To see if the Town will vote to transfer from free cash the sum of $12,395 to Fire Department Expenses - Clothing & Education; or take any actions relative thereto. (Due to settlement of Contract Negotiations and to fund the education incentive that was inadvertently left out of the Fire Department budget)

Article 6.  To see if the Town will vote to raise and appropriate or transfer the sum of $_____________________ to Fire Department Wages – Emergency Callback Overtime; or take any actions relative thereto: (Due to settlement of Contract Negotiations)

Article 7.  To see if the Town will vote to transfer the sum of $34,732.25 from the Ambulance Receipts Account to the Ambulance Operating Account-EMT Stipends; or take any actions relative thereto. (Due to settlement of Contract Negotiations)

Article 8.  To see if the Town will vote to transfer from the General Stabilization Account the sum of $ 31,000 for a new Officer’s Vehicle for the Fire Department; or take any action relative thereto. (This is to replace the 1999 Ford F-250 Utility Body vehicle that was involved in a motor vehicle accident last month. The 1999 Ford F-250 Utility Body was a total loss and has to be replaced as it is a front line vehicle used 24 hours a day by the Department. This money will be added to the insurance money received, for the purchase of an equivalent replacement vehicle for the Fire Department.)

Article 9.  To see if the Town will vote to transfer from the General Stabilization Account  the sum of $24,753.82 as noted below to accounts for changes in positions in the Fire Department; or take any actions relative thereto.

Article 10.  To see if the Town will vote to raise and appropriate or transfer the sum of $30,122 to Fire Department Wage – Stipends for Retirement Benefits of 2 Fire Fighters who retired this year; or take any actions relative thereto.

Article 11.  To see if the Town will vote to transfer from free cash the sum of $21,000 to be used to compensate the Town of Bridgewater for their FY 07 expenses for local building inspections of the new Bridgewater-Raynham Regional High School; or take any action relative thereto. (Submitted by the Board of Selectmen)

Article 12.  To see if the town will vote to transfer from the Assessor’s Overlay Surplus Account the sum of $5,000 for the purchase of a duplex color printer for the Assessors Department; or take any action relative thereto. (Submitted by the Board of Assessors)

Article 13.  To see if the Town will vote to transfer the sum of $91,000 from the Sewer Enterprise for the Fiscal Year 2007 Payment for Infiltration / Inflow Contribution in accordance with the Agreement for Wastewater Treatment Between the City of Taunton, MA and the Town of Raynham, MA dated October 3, 2006; or take any action relative thereto.

Article 14.  To see if the Town will vote to accept the provisions of M.G.L.c.39, s.23D and apply those provisions to adjudicatory hearings of all Town of Raynham municipal boards, committees or commissions, said provisions permitting Town of Raynham board, committee or commission members who missed a single session of an adjudicatory hearing before their board, committee or commission to be able to vote on the matter provided that they review the evidence submitted at the missed session, which evidence shall include an audio or video recording of the missed session or a transcript thereof, and they file a written certificate to that effect with the board, committee or commission; or take any action relative thereto.

Article 15.  To see if the Town will vote to accept M.G.L. Chapter 32B, Section 18; or take any action relative thereto.
Note: This article, if accepted, would require retirees of the Town of Raynham, who are eligible for or enrolled in Medicare Part A, to transfer to a Medicare supplement plan offered by the Town.

Article 16.  To see if the Town will vote to appropriate $48,000 from funds to be given to the Planning Board by Intoccia Construction Company, 2 Washington Street, Foxboro, MA 02035 in order to conduct a drainage study for the Hill Street culvert that presently is flooding and to take all actions necessary to implement the drainage improvement.   The drainage study was a condition of the Bella Estates Special Permit/Site Plan for 55 condominiums.  The study at a minimum shall identify the watershed that flows through the Hill Street culvert, identify a solution to eliminate this flooding and identify a solution that prevents flooding in the future as future development occurs within this watershed.  The study at a minimum shall also design permit plans for the drainage solution.  The money shall also be used for any action necessary to implement the drainage improvements.  The Planning Board or their designated agent shall be responsible for managing this project; or take any action relative thereto.

Article 17.  To see if the Town will vote to appropriate $75,726 plus any interest accrued from funds held by the Zoning Board of Appeals obtained from Can-Four Corporation, 1017 Turnpike Street, Canton, MA 02021, in order to obtain comprehensive engineering services as described below related to a multi-use path along one (1) side of Elm Street East and/or Hickory Drive.   The money was mitigation for the Comprehensive Permit that was issued by the Zoning Board of Appeals to Can-Four Corporation.  The project will include approximately one and half (1.5) miles of a new multi-use path along one side of Elm Street East and possibly Hickory Drive.  The proposed project will be phased into three separate milestones.  The first is a preliminary project kick off stage that will include a conceptual design and public meeting.  The second phase will be the 25% (preliminary) design of the preferred alternate for implementation with a detailed survey and funding application.  The final stage will be the 75%/100%/PSE biddable contract documents for construction.  Tasks may include one or more, but are not limited to, the following;
Topographic survey including assessor and utility information, Functional Design Report, Public Meetings, Mass Highway Meetings, Conceptual alternates, Geometric improvements to roadways and intersections, Traffic & safety analysis and modeling, Permitting,  Streetscaping, Pedestrian and bicycle facilities, Geotechnical and/or structural engineering, Drainage and culvert analysis and design, Contract Documents, Construction Estimates, Construction Services, Plan submittals to the Town and Mass Highway, any other tasks in order to implement this project. The Zoning Board of Appeals or their designated agent shall be responsible for managing this project; or take any action relative thereto.
Article 18.  To see if the Town will vote to appropriate $4,661 plus any interest accrued from funds held by Planning Board obtained from Dan Andrade, Trustee, Dan Andrade Realty Trust, 68 North Main Street, Raynham, MA 02767.  The money is to be used for improvements of traffic conditions for Route 138, which the Planning Board has determined can be done through a comprehensive zoning study for Route 138.  The town appointed Route 138 Zoning Study Committee or their designated agent shall be responsible for managing this project; or take any action relative thereto.

Article 19.  To see if the Town will vote to rescind Article 31 of the October 30, 2006 Special Town Meeting and to appropriate the sum of $7,605.00 from that article to hire a part-time, temporary employee (expiring June 30, 2007), under the supervision of the Town Administrator, for the purpose of coordinating volunteers in the three Raynham Schools; all activities to be authorized and monitored by the three school principals, or take any action relative thereto.

     And you are directed to serve this Warrant, by posting up attested copies thereof at the seven (7) places directed by vote of the Town, in said Town, fourteen (14) days before the time of holding said meeting.

     HEREOF FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.
