WARRANT FOR SPECIAL TOWN MEETING OF 11-9-09

SPECIAL TOWN MEETING

November 9, 2009


Bristol, ss.

To either of the Constables of the Town of Raynham, in the County of Bristol, GREETING.

    IN THE NAME OF THE COMMONWEALTH OF MASSACHUSETTS, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Middle School’s Joseph A. Bettencourt Auditorium in said Raynham, on the 9th day of November, at 7:00 in the evening, then and there to act on the following Articles: --


ARTICLE 1.  To see if the Town will vote to transfer from the Ambulance Receipts Reserved Account the sum of $234,400 as detailed below to the Ambulance Operating Account, for the purpose of operating the Ambulance Service for the Fire Department for the last six (6) months of FY 2010, or take any action relative thereto. (Submitted by Fire Department)

ARTICLE 2.  To see if the Town will vote to transfer from Free Cash the sum of $3,350 to the Cemetery - Personnel Expenses for the purpose of retention of seasonal worker through June 30, 2010, or take any action relative thereto. (Submitted by the Cemetery Commission)
ARTICLE 3. To see if the Town will vote to transfer from Overlay Surplus the sum of $10,000 for payment of the FY 2011 Building Permits and maintenance services, or take any action relative thereto. (Submitted by the Board of PersonNameAssessors)
ARTICLE 4. To see if the Town will vote to appropriate $30,000 from the Carriage Hill Municipal Improvements  Escrow Account  for the purpose of funding  a complete Feasibility Study for the construction of additional housing units for the elderly or disabled population on a site owned by the Raynham Housing Authority  on Mill Street, Raynham; or take any action relative thereto. (Submitted by the Planning Board)

ARTICLE 5. To see if the Town will vote to accept as a town way Ashley Way as shown as an unnamed road on a Plan of Land recorded in the Bristol County Northern District Registry of Deed at Book 253, Page 64 and to vote to authorize the Board of Selectmen to acquire said road by purchase, eminent domain, gift or otherwise, the fee in Ashley Way on the condition that it be at no cost to the Town, or take any action relative thereto.
Note: An affirmative vote would reconfirm acceptance of addressStreetAshley Way which was accepted by the Town in 1993.

ARTICLE 6. To see if the Town will vote to transfer from Free Cash the sum of $2,450.30 for a prior year bill from William August, Esq., the Town’s cable television attorney, for negotiating the cable television contract with Comcast for the Town, or take any action relative thereto. (Submitted by the Board of Selectmen)

ARTICLE 7.  To see if the Town will vote to transfer from Free Cash the sum of $_________  as an “other financing source” for the purpose of reducing the deficit from the Governor’s mid-year reductions to Local Aid, or take any action relative thereto. (Submitted by the Board of Selectmen)
Note: Funds will be needed if the Governor makes mid-year cuts to Local Aid as anticipated.

ARTICLE 8. To see if the Town will vote to transfer from Free Cash the sum of $137,500 to a Stabilization Account established for the maintenance and repair of Raynham’s Schools, or take any action relative thereto.

ARTICLE 9. To see if the Town will vote to transfer from Free Cash the sum of $317,000 to a Stabilization Account established for the maintenance, repair or replacement of the Town’s Stormwater Infrastructure including any associated engineering or design costs, or take any action relative thereto.

ARTICLE 10. To see if the Town will vote to transfer from Free Cash the sum of $329,000 to a Stabilization Account established for the operation and maintenance of the Town’s Solid Waste Facilities, including the Transfer Station and former Landfills, or take any action relative thereto.

ARTICLE 11. To see if the Town will transfer from Free Cash the sum $32,500 for the purchase of one new police cruiser, or take any action relative thereto. (Submitted by the Capital Planning Committee)

ARTICLE 12. To see if the Town will transfer from the Ambulance Receipts Reserved Account the sum $211,000 for the purchase of a new Class 1 Ambulance, or take any action relative thereto.
Note: An older (2002) ambulance will be traded in. (Submitted by the Capital Planning Committee)

ARTICLE 13. To see if the Town will transfer from Free Cash the sum of $16,500 and from the Fire Alarm Revolving Account the sum of $23,000 (for a total of $39,500) for the purchase of a new Fire Chief’s vehicle, or take any action relative thereto. (Submitted by the Capital Planning Committee)
Note: The current Chief’s vehicle will replace the Fire Inspector’s vehicle (a 2000 Ford Contour with 140,000 miles)

ARTICLE 14. To see if the Town will transfer from the Sewer placeCityEnterprise Retained Earnings Account the sum $40,329 for the purchase of a Ford F-350 for the Sewer Department, or take any action relative thereto. (Submitted by the Capital Planning Committee)

ARTICLE 15. To see if the Town will transfer from the Sewer Enterprise Retained Earnings Account the sum $23,050 for the purchase of John Deere 3320 Tractor with attachments, or take any action relative thereto. (Submitted by the Capital Planning Committee)

ARTICLE 16.  To see if the Town will vote to transfer from Free Cash the sum of  $5,000 to upgrade various tools and recondition equipment needed on Fire Department vehicles, or take any action relative thereto. (Submitted by the Fire Department)

ARTICLE 17. To see if the Town will vote to transfer from Free Cash the sum of $9,000 for upgrades to the Town computer system, or take any action relative thereto.

ARTICLE 18. To see if the Town will vote to transfer from Free Cash the sum of $___________  to the Police Department Personnel Expense account for the purpose of funding the settlement of a collective bargaining agreement for FY 2010, or take any action relative thereto.

ARTICLE 19. To see if the Town will vote to transfer from Free Cash the sum of $10,225 to the Police Department Personnel Expense account for reimbursement of wages paid to an officer injured on duty, or take any action relative thereto. (Submitted by the Police Department)
Note: Payments made to the Town by its insurance company for wages of officers injured on duty are required by the Department of Revenue to go to the General Fund.

ARTICLE 20. To see if the Town will vote to transfer from Free Cash the sum of $10,000 to fund medical bills for officers injured on duty not covered by the Town’s insurance (co-pays/deductibles), or take any action relative thereto. (Submitted by the Police Department)

ARTICLE 21. To see if the Town will transfer from Free Cash the sum of $__________ to the General Stabilization Account, or take any action relative thereto.

ARTICLE 22.  To see if the Town will vote to transfer the sum of $195,830.41 from the Sewer Stabilization account to pay a portion of the Sewer construction debt, or take any action relative thereto.

ARTICLE 23.  To see if the Town will vote to amend Article 13 of the 2009 Annual Town Meeting by deleting the strike-through language and adding the language in bold print, or take any action relative thereto.

ARTICLE 24. To see if the Town will accept as a gift, purchase or take by eminent domain the following permanent easements in, on, under and above parcels  PE-1, PE-2 and PE-3 as described below and shown on a plan prepared by Nitsch Engineering entitled “ Plan Showing Permanent Easements, Hill Street, Raynham, Massachusetts” dated October 6, 2009, for the public purpose of maintaining, altering, repairing, relocating and/or reconstructing a culvert and appurtenant structures on Hill Street, a copy of said plan being on file in the Office of the Board of Selectmen; or take any action relative thereto.  Funds have already been appropriated in Article 23 of the 2006 Annual Town Meeting. A certain strip of land lying within the land now or formerly of Dorrine M. Fisher located on the northerly side of addressStreetHill Street in CityplaceRaynham, StateMassachusetts, bounded and described as follows:

Beginning at a point on the northerly sideline of addressStreetHill Street, said point being the southwest lot corner of Dorrine M. Fisher;
Thence running N 01o44’42’E, a distance of 30 feet along the westerly lot line of Dorrine M. Fisher;
Thence turning and running N 85o40’20”E, a distance of 105 feet;
Thence turning and running S 07o30’16”E, a distance of 30 feet to a point on the northerly sideline of addressStreetHill Street;
Thence turning and running westerly by a curve to the right having a radius of 975.00 feet, a distance of 110 feet along said northerly sideline of addressStreetHill Street to the point of beginning.

A certain strip of land lying within the land now or formerly of Trustees of Fox Hill Farm Trust located on the southerly side of addressStreetHill Street in CityplaceRaynham, StateMassachusetts, bounded and described as follows:

Beginning at a point on the southerly sideline of addressStreetHill Street, said point being the northeast lot corner of Trustees of Fox Hill Farm Trust;
Thence running southeasterly, a distance of 44 feet along the northeasterly lot line of Trustees of Fox Hill Farm Trust;
Thence turning and running S 08o45’54”E, a distance of 13 feet;
Thence turning and running S 84o20’29”W, a distance of 114 feet;
Thence turning and running N 02o33’09”W, a distance of 30 feet to a point on the southerly sideline of addressStreetHill Street;
Thence turning and running easterly by a curve to the left having a radius of 1025.00 feet a distance of 71 feet by said sideline of addressStreetHill Street to the point of beginning.

A certain strip of land lying within the land of now of formerly of Frank L. and Evelyn E. Pacheco located on the southerly side of addressStreetHill Street in CityplaceRaynham, StateMassachusetts, bounded and described as follows:

Beginning at a point on the southerly sideline of addressStreetHill Street, said point being the northwest lot corner of Frank L. and Evelyn E. Pacheco;
Thence running easterly by a curve to the left having a radius of 1025.00 feet, a distance of 40 feet by the southerly sideline of Hill Street;
Thence turning and running S 08o45’54”E, a distance of 17 feet to a point on the southwesterly lot line of Frank L. and Evelyn E. Pacheco;
Thence turning and running northwesterly, a distance of 44 feet along said lot line of Frank L. and Evelyn E. Pacheco to the point of beginning.

The above described strip of land contains an area of  about 335 square feet and is shown as PE-3 on a plan titled “Plan Showing Permanent Easements, Hill Street, Raynham, Massachusetts” dated October 6, 2009, prepared by Nitsch Engineering, Inc.

ARTICLE 25. To see if the Town will vote to amend Article 10 of the 2009 Annual Town Meeting by deleting the strike-through language and adding the language in bold print, or take any action relative thereto.

ARTICLE 10.  To see if the Town will vote to raise and appropriate the sum of $1,546,059  $1,537,643 for the purpose of paying the debt service on the outstanding bonds and notes for the Raynham Middle School, the renovation projects for LaLiberte Elementary School and the Merrill School and for the new regional High School; or take any action relative thereto. (Submitted by the Board of Selectmen)                                                                        

    And you are directed to serve this Warrant, by posting up attested copies thereof at the seven (7) places directed by vote of the Town, in said Town, fourteen (14) days before the time of holding said meeting.

     HEREOF FAIL NOT, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.
