The meeting of the Raynham Conservation Commission was called to order at 6:00pm.

The Meeting of the Raynham Conservation Commission was closed at 8:02pm

Informal Meeting

1. RNR Plastics

DISCUSSION
Tom Pozerski, Hayward, Boynton & Williams, was present and recommended changes to the existing site plan.  Mr. Pozerski informed the Commission that the bio-retention basin construction was not possible due to topography and poor soils onsite.  He recommended that the bioretention basin be constructed as a wet pond. Mr. Pozerski recommended adding stone to the settling basin with no inlet/outlet structure change.  Mr. Smith questioned the type of stone material to be used.  Mrs. Rochette asked if the consulting engineer for the Town had approved the changes.  
           
Discussion continued to January 18, 2007 pending the receipt of an approval from Nitsch Engineering.

 2.  William Smith welcomed to be Commission by all members

        3.  REORGANIZATION OF THE COMMISSION
        
Mary Ellen Rochette motioned and William Smith seconded for Dave McRae    and Shelly Coelho to be Co-chairpersons of the Commission.  The vote made it unanimous.


Mary Ellen Rochette motioned and William Smith seconded to appoint Shelly       Coelho and Dave McRae as representatives for the Conservation Commission to serve on the Borden Colony Committee.  The vote made it unanimous.
   
Motion was made and seconded for Mary Ellen Rochette and William Smith to approve payroll for staff positions.  Commissioners concurred to appoint William Smith as Recording Secretary. The vote made it unanimous.

4.  Commission Members concurred to cancel the scheduled meeting for March 1, 2007 and to re-schedule at a later date.

5. The Agent informed of the closures of Town Hall offices during the move to the new Town Hall/Sullivan School.

6.  Site Visits

   DISCUSSION

        A. Kenney Road, Lot 2-Request for Building Permit
 
B. Theresa Road, Map 4, Lot 108-12 across from 88, request for New Building permit

C. Hathaway Village-King Estate, request for extension.  The Agent informed the Commission that neither Richard McCarthy nor Mr. Schmid has visited the site and would gladly accompany Agent on a site visit.  Agent stated that all hay bales should be in place prior to Commission approving request for extension and that the Order of Conditions must be in compliance at the time of the site visit.  Agent informed that Commission could also approve a 1-3 year extension.

1.      Continuation of a Public Hearing relative to the filing of a request for determination of  applicability under the Wetlands Protection Act, Mass. G.L. Chapter 131, Section 40.  The request for determination of applicability is being submitted for the confirmation of the boundaries of resource areas as delineated.  The project location is Assessors Map 18, Lots 19 and 19A, 513 Church Street, Town of Raynham.  The request for determination of applicability is being submitted by Russell Yule.

DISCUSSION
   
 The Agent confirmed that a site visit was conducted on January 3, 2007.  Mr. McRae stated that he, the Agent, Jim Ross and William Smith visited the site and there were additional flags on the property and that the plan had been revised since the last meeting.  The Agent read Mr. Hewitson’s letter to Dan Andrade aloud regarding two intermittent streams on the property, as subsumed in the flagging for bordering vegetated wetland. The letter explained Mr. Hewitson’s analysis regarding whether or not the streams were perennial or intermittent.
    
 Motion made by Mr. Smith and seconded by Ms. Rochette to approve Plan
dated December 30, 2006 and to issue a positive 2A to approve the resource areas   as shown.  The vote made it unanimous.

Present was Richard McCarthy who discussed and explained to the Commission Transfer Development Rights – TDR., as it relates to any development proposals and procedures for the site.


2.      DEP #269-0799
Continuation of a Public Hearing relative to the filing of an abbreviated notice of resource area delineation under the Wetlands Protection Act, Mass. G.L. Chapter 131, Section 40.the abbreviated notice of resource area delineation is being submitted for the confirmation of the boundaries of resource areas as delineated.  The project location is Assessors’ Map 12, Lot 242A, 219 Buck Knoll Road, Town of Raynham.  The abbreviated notice of resource area delineation is being submitted by Brian Strausbaugh.

DISCUSSION

The Agent confirmed a site visit on January 4, 2007 and flag markings.  Mr. Smith motioned and Mary Ellen Rochette seconded to accept the plan dated December 15, 2006, and issue an ORAD.  The vote made it unanimous.


3.      Opening of a Public Hearing relative to the filing of request for Determination of Applicability under the Wetlands Protection Act, Mass. G.L. Chapter 131, Section 40.  The filing of request for determination of applicability is being submitted for the repair of an existing subsurface sewage disposal system and associated grading and for the verification of the wetland delineation within the 100-foot buffer zone to a bordering vegetated wetland.  The proposed project is located at Assessors’ Map 18, Lot 29, 69 River Street, Town of Raynham.  The filing of request for determination of applicability is being submitted by Theresa Markham.

DISCUSSION

Lou Quinn from Michael Koska and Associates was present and informed the Commission that the plans are revised only due to notes added for the variances as requested from the Board of Health.  Mr. Quinn stated that the Board of Health has reviewed and approved said revised plans. Mr. Quinn stated that the plans are for a single-family residence upgrade and is requesting confirmation from the Commission of the wetland lines.  The Agent and Dave McRae conducted a site visit last week Mary Ellen Rochette motioned and William Smith seconded to approve plans dated December 4, 2006, and to issue a positive 2A and a negative 3 with test conditions. The vote made it unanimous.

4.      Opening of a Public Hearing relative to the filing of a Notice of Intent under the Wetlands Protection Act, Mass. G.L. Chapter 131, Section 40.  The Notice of Intent is being submitted for the construction of a proposed 55-unit residential condominium complex in ten buildings along with associated parking, driveway, grading, utilities, and drainage that lies partially within the 100-foot buffer zone to a bordering vegetated wetland.  The proposed project is located at Assessors’ Map 15, Lot 176-4J, Hill Street, Town of Raynham.  The Notice of Intent is being submitted by Intoccia Construction Co.

DISCUSSION

Mr. Buckley was present and presented the Commission with plans for a 55-unit condominium complex, in three separate buildings, on Hill Street.  Mr. Smith questioned what materials will be used to build the stonewall as shown on the plan.  Mr. Buckley confirmed that it is not stone, but segmental retaining blocks per the Commission’s specifications.  Mr. Smith questioned the proposed maintenance plan.  Mr. Buckley informed that the proposed plan is for an inspection twice a year. Ms. Ueberbacher stated that the Construction and Maintenance plan would be a document that could be referenced in the order of conditions should the commission choose to issue one. Mrs. Rochette stated that the Commission would have concerns with the development due to the responsibility of the developer and the timing of the transfer to the homeowners association.  Mrs. Rochette recommended the development be 100% sold prior to the transfer to the homeowners association. Mr. Smith expressed concerns with the slope and the maintenance due to erosion.  Mr. Smith requested a copy of an inspection report weekly to be forwarded to the Commission.  Mr. McRae asked if there was a designated location for which snow would be plowed/piled to.  Mr. Smith requested a special condition of no snow storage within 100’ of wetland.  Mrs. Rochette requested that the snow/removal area be labeled on the plan. Anne Avelino, 370 Hill Street, was present and expressed concerns of erosion and runoff into a stream on her property.  She indicated the she was opposed to issuing any more permits to build on Hill Street. The Agent informed the Commission that the plan was approved by the Planning Board.  Mr. Buckley informed the Commission that the applicants did not have to seek any special permits through the zoning board of appeals. Mr. Smith motioned and Mrs. Rochette seconded to continue to January 18, 2007 so that the plan can be revised to show snow storage. The vote made it unanimous.


5.      Opening of a Public Hearing relative to the filing of a request for determination of applicability under the Wetlands Protection Act, Mass. G.L. Chapter 131, Section 40.  The request for determination of applicability is being submitted for the construction of a 30’ by 45’ barn and an 18’ x 36’ above ground swimming pool within the 100 foot buffer zone area from the BVW.  The project is located at Assessors’ Map 11, Parcel 190A, 57 Pamela Way, Town of Raynham.  This request for determination of applicability is being submitted by John Dominique.

Postponed until January 18, 2007

6.      DEP #269-0797
Continuation of a public hearing relative to the filing of a Notice of Intent under the Wetland Protection Act, Mass. G.L. Chapter 131, Section 40.  The Notice of Intent is being submitted for the construction of driveway aprons, utility connections and service lines, one stormwater drainage system, the installation of a water main on Mill Street, 150 feet +/- of roadway with associated grading, five foot sidewalks, handicap ramps, and curbing; and associated erosion control measures within the 100 foot buffer zone to a bordering vegetated wetland and two hundred foot river protection zone as applicable.  The proposed project is located at Assessors’ Map 8, Lot 225, Mill Street, Town of Raynham.  The Notice of Intent is being submitted by Alice Gonsalves.

7.      DEP #269-0772
Continuation of a Public Hearing relative to filing of a Notice of Intent for the construction of a single-family home with associated driveway, grading, fence, and utilities within 100 feet of existing wetlands and a previously approved restoration area.  The proposed project is located at Assessors’ Map 3, Lots 460, 461, 189 Overlook Drive, Town of Raynham.  The Notice of Intent is being submitted by Steve Parker.

Continued until February 1, 2007
