 FINAL MINUTES FOR THE RAYNHAM CONSERVATION COMMISSION MEETING ON FEBRUARY 2, 2006



The meeting of the Raynham Conservation Commission was called to order at 7:00 p.m.

The meeting of the Raynham Conservation Commission was closed at 9:00 p.m.

Informal Meeting

        1.      Discussion re:  Wildflower Green

                DISCUSSION:
        In attendance were:  John Schmid, Consulting Engineer, Mike Jones from Can-Four Corp. (Construction Company), Todd Undzis from HW Moore (Engineer), and Bob Newton, Zoning.  John Schmid reviewed the letter he had issued with his findings with the Commission.  His recommendations were to have the applicant provide the soil data including roof recharge areas, complete basin 2 construction, provide as builts to see what was constructed, and have the engineer go back and do a second analysis pre and post to see if anything needs to be changed.        

                DECISION:
                The decisions that were made were to 1)  have soil tests be conducted in each basin and near each basin to determine the conditions, the tests are to be witnessed by John Schmid or the Board of Health 2)  basin two construction is to be completed, and 3)  provide as builts of everything that has been constructed including all the basins and infrastructure in order to compare the volume to what was indicated on the approved plan of record, 4) include the as builts for the roof recharge areas, and 5) once all the work is done, the applicants should go back and revisit the design and provide information back to the Commission as to whether or not any redesign is necessary.

Motion to accept the budget as detailed by John Schmid less an invoice amount of 887.85 which was paid on 1/19/06 with revision to the budget total to make it a total of $6,000.00 to be payable by the applicant and held in an escrow account by the Town of Raynham. The representative for the applicant, Mike Jones agreed to pay a remainder of $5200.  Anything over the $6000 will need to come back to the Conservation Commission before work is conducted.

        1.      DEP # 269-0767
Opening of a public hearing relative to the filing of an Abbreviated Notice of Resource Area Delineation submitted to confirm the boundaries of 1,222 of Bordering Vegetated Wetlands on Route 44, Assessors' Map 15, Parcel 148B, Town of Raynham.  The Abbreviated Notice of Resource Are Delineation is being submitted by Eclipse Realty Management, LLC.

                DISCUSSION:
        The party representing the applicant was last here on January 5.  A site visit needed to be done on the land next to Wendy's on Rt. 44.  The site visit was held on January 20, and went very well.  David McRae, Conservation Commissioner, and Erika Ueberbacher, Conservation Agent went out on the site visit.  The applicant did extra soil tests.  All soil logs and data logs were provided in the original filing.



                DECISION:
        There were no issues with the wetland line.  The Conservation Agent recommended to the Commission to approve the Bordering Vegetative Wetland line delineation flags 1B - 25B.

        Continued Public Hearing relative to the filing of a Notice of Intent for the construction of a subdivision roadway and two houses with associated grading and utilities.  The project location is 30 Robinson Street, Assessors' Map 1, Parcel 27 and 28, Town of Raynham.  The Notice of Intent is being submitted by Hanson and Associates.

                DISCUSSION:
The applicant was waiting for the DEP File #.  They now have the DEP File #.  They received Planning Board approval last week.

        Opening of a Public Hearing will be held by the Raynham Conservation Commission relative to the filing of a Notice of Intent for the construction of a single family home with associated grading, deck, landscaping, and utilities within the 100 foot buffer zone of Bordering Vegetated Wetlands, Lot 4, off 186 White Street, Assessors' Map 8, Parcel 57, Raynham.  The Notice of Intent is being submitted by John Zappala.


                DISCUSSION:
        The Commission had requested a culvert system.  Joe Medeiros from the Raynham Highway Department and Erika went out and inspected the drainage system.  The culvert system exists down the road and not on this property.  The catch basin adjacent to this property is not for this side of the road and is for the opposite side of the road.  There is no drainage swale on this property.  The plan was amended with a split rail fence at a 25' no touch zone.

                DECISION:
Need to amend the request for the culvert, and issue an OOC.

        Opening of a public hearing relative to the filing of a Request for Determination of Applicability for the construction of a single family home with associated grading, deck, landscaping, and utilities more than 60' away from Bordering Vegetated Wetlands.  Lot 1, off 186 White Street, Assessors' Map 8, Parcel 57, Raynham.  The Request for Determination of Applicability is being submitted by John Zappala.

                DISCUSSION:
        Joe Medeiros from Highway, and Erika Ueberbacher, Conservation Agent, went out onsite and tracked the drainage.  A culvert system exists down the road and not on this property.  The catch basin adjacent to this property is not for this side of the road and is for the opposite side of the road.  There is no drainage swale on this property.  
                
                DECISION:
        Recommended that there is no need for a culvert system.  Outback Engineering reviewed the site and made the same conclusion.  The Commission amended the vote from the last meeting to put in a culvert system and issue a DOA and approve plan dated 1/23/06.

        Issue a DOA negative three with standard conditions and approve plan dated 1/23/06.  Need to include a copy of the one page of conditions with the building permit.

Opening of a public hearing relative to the filing of a Request for Determination of Applicability for the removal of brush piles and yard waste, removal of grape vines 10 feet off of the house corner, grass seeding, planting of trees, and minor landscaping involving the construction of a fountain, stone wall, and lattice fencing, at 454 South Street West, Map 14, Lot 162, Raynham, MA.  The Request for Determination of Applicability is being submitted by Obie Ruth Ann O'Brien.

                DISCUSSION:
        Ms. O'Brien would like to clean up the area behind her house which is near the wetlands.

                DECISION:
        Con Comm has determined that Ms. O'Brien can work 10' from her house as the limit of work in order to clean up the grape vines.  She is to set a line of hay bales down to the grass clippings, and follow the bank to where the proposed fountain is at the end.  The grass clippings will need to be pulled back.  She may work in this area, and when finished, she may remove the hay bales with permission from the Conservation Commission.  Ms. O'Brien is also to remove the brush pile, and follow the DEP's requirements and Cons Comm recommendations re : burning in the wetlands.

        This is a partly cleared site, and a silt fence is put in.
