Informal Meeting
1. Discussion with Adam Last regarding a revised plan for DEP file #269-702. United Service Station, 593 Broadway, Raynham, MA
DISCUSSION:
Adam Last spoke with ConComm regarding the United gas station on the corner of Britton and Broadway. It is closed at this time due to historical gas leaks. An NOI was issued to install a system on the property to address this. The system is installed and operating well, although, the NOI has not been closed out yet. There are some additional site work activities to be done that require the ConComm's permission. The proposed items to be done are to remove in-ground storage tanks, and replace with new tanks; the dispenser island is to be removed; replace canopy; and, there is anticipation of some contaminated soil which will need to be managed at an asphalt stocking site. The ConComm is concerned about not removing
contaminated soil right away. The reason it would not be removed right away is that the soil is to be tested for contamination, and disposal parameters, before it can be taken away. The DEP allows a stock pile for 120 days, but ConComm does not want to wait that long. There was a question regarding if kids in the area would be harmed in any way due to this type of work. There was a question from a commissioner on if they could do the contamination testing in the "hole" before taking it out of the hole.
DECISION:
The request(s) put forth to Adam Last via ConComm is/are as follows:
- put the soil in a lined dumpster which should help avoid runoff from a "pile" of contaminated soil,
- make a hay bale barrier around, and underneath, the "pile" (if no dumpster),
- cover the dumpster, or "pile", with plastic each evening
- rebar may need to be used, and driven into the pavement to reinforce the hay bale line,
- the Commission would, also, like to add some freestanding construction fences, so that children, and others, will stay clear of the work going on at this location
- reinspect and redo the existing hay bale line
- place a boon on the inside of the hay bales
- have a dumpster on-site for scrap metal

Discussion re: Mastria Subaru Nissan parking revision plan
DISCUSSION:
A full new set of drawings was provided to the ConComm, and the Commission voted on them with the addition of one page.
The Agent met with everyone with a full set of all the pages that was wanted, with all the various dates attached. It is the same as what is in the building set.
An adjustment was made, per Roger Stolte, on the design review regarding a different type of outlet structure.
The footings were poured, and a Commissioner was not pleased with this, however, there appeared to be some confusion on this topic. The Agent spoke with the Nissan group the very next day, and allowed them to do the footings.
It was mentioned to capture in the record that there is no page 2. On 4/6/06, the ConComm voted, unanimously, to accept the following plan pages (dated as follows) as the new plan of record for the Mastria Subaru Nissan NOI:

10. Discussion re: Mastria Sewer Line Tie in, update to Commission
DISCUSSION:
Tom Pozerski sent updated pictures.
More of an update on progress will be made at the second meeting in June - June 15. It might be all done, and ready to go at that point.
If they so choose, they may put the enforcement order onto the agenda, and decide if they want to lift it, but, right now, just an interim progress report with pictures will be fine.
The Agent does not foresee that anything can be lifted, or accrue, at least until the second meeting in June to ensure that the soil and plantings stabilize.

11. Discussion re: Work done by T & M

DISCUSSION:
Mr. Keller provided an update on this project. The ConComm Agent, and other town official members, did a walk through, and spoke with Mr. Rozenas. It appears that many dirt bikes ride where the pipe is, the area that slopes down to the wetlands. It was agreed that bigger stones would be put at the bottom to help prevent dirt bike riders from going up the steep slope from the Cons Com land.
The ConComm Agent explained that she needed to go out there as a follow up to a previous Cons Com meeting Ms. Janet Ross of 42 Britton Street was in attendance. There was some discussion regarding a gate and some private property signs, and planting some trees and shrubs around it.
There was, also, some concern that road salt would get into some of the plant cells that will, eventually, kill off the vegetation that is trying to be grown. Mark Perrin has easement rights, and he will move back the plant cells in the first section to get away from road salt.

Erika Ueberbacher - Review minutes to see what they say regarding the private property signs, the gate, and the trees, and shrubs around it, and the grate of the pipe. Also, mention to Mr. Perrin that there was an issue with the easement. The end of the outlet was on private property. Work can only be done in an easement or on ConComm property, but not on private property. She will also mention that there is a desire to do some fencing around the bar rack. The bar rack on the inlet made it onto the revised plan, as well as, the concrete manhole cover, but fencing is not on the plan, and it wasn't voted on at the time. Follow up to see if Mr. Perrin is willing to do this.

1. Opening of a public hearing relative to the filing of an Abbreviated Notice of Resource Area Delineation for the confirmation of a 421-foot Bordering Vegetated Wetland line at 235 Overlook Drive, Assessors' Map 3, Parcel 459, Town of Raynham. The Abbreviated Notice of Resource Area Delineation under is being submitted by William Zolga.
DISCUSSION:
Mr. Richard Keller of HBW represented the Zolga's. ANRAD slips and NOI were submitted. Mr. Keller met with the Agent earlier in the week, and revised the plan. The ANRAD, and the NOI plans, are very similar. Some of the changes are: add entire length of wetlands, flags on the site, add the indication that there is a 4-inch PVC pipe that dumps into the wetlands from a neighboring lot next to the culvert. Mr. Keller is not sure what this pipe does.
There is a stream on the property, but there are no streams showing on any maps. This one has a gravelly base, and is flowing well. The Chairman asked why it did not get delineated. An abutter on Hall Street mentioned that the stream runs behind his property, and it runs all the time.

2. Opening of a public hearing relative to the filing of a Notice of Intent for the construction of a 1,285 square foot addition and porch at 235 Overlook Drive, Assessors' Map 3, Parcel 459, Town of Raynham. The Notice of Intent is being submitted by William Zolga, 235 Overlook Drive.
DISCUSSION:
Based on if the ConComm approves #1 above, the ANRAD.

3. Opening of a public hearing relative to the filing of a Notice of Intent for the expansion of an existing commercial building with wetland filling and replication at 20 Bellows Road, Assessors' Map 14, Parcel 242-3, Town of Raynham. The Notice of Intent is being submitted by Arthur Pearlstein, R. N. R. Realty, LLC.
DISCUSSION:
Mr. Keller, of HBW, brought the latest set of plans revised to April 5, 2006. A wetland line was already approved for it. The company is proposing an addition to use for warehouse. The proposed building would have additional parking in the back, and a driveway. The applicant has had discussions with the town consultant, and would need to change the parking at the existing entrance, regrade it, and make compliant.
Part of the project includes filling a wetland, proposed bio-retention, and a replication area. It includes a proposed waterfall inlet, big tank, and discharge to sediment cap basin overflow into bio-detention area.
ConComm was concerned that all the pervious runoff would go in the detention basin. Mr. Keller responded that no green areas were being added, and that this meets the minimum requirement 80% storm water management policy. ConComm also wanted to know if there would be planting in the bio-retention, and Mr. Keller responded that there would be in the marsh area, and on the sides. Further, ConComm asked about a planting plan, and Mr. Keller responded that there was one.
Lastly, ConComm asked about snow removal, and how it would be done as the site is taken up. Also, since a new wetland will be created in the replication area, a new wetland line will need to be located. ConComm, also, agreed that the parking lot will need to be within 10 feet of the site.
ConComm all agreed that this site was pretty degraded, and it will end up with better conditions.
Continue this to 4/20, and have the revised plan ready to be signed.

Mr. Keller needs to show the snow removal area on the plan, and it is not to be in the bio-retention area. Continue to 4/20, and have the revised plan ready to be signed.

Continuation of a public hearing relative to the filing of an Abbreviated Notice of Resource Area Delineation to confirm the boundaries of 400 feet of Bordering Vegetated Wetlands for 241 Church Street, Assessors Map 18, Parcel 36-2, Town of Raynham. The Abbreviated Notice of Resource Delineation is being submitted by Frank Morreale III.
DISCUSSION:
Mr. Hewitson walked the line on this property, and indicated on the plan that there are 7 fill piles on this site, and three of them are within wetlands. He mentioned that this is an old wetland line, and not all flags are shown on the plan. It was agreed that the line would be moved to the present location based on what they could see at the time. ConComm also asked that he make some soil samples with his auger, and mark those with orange flags. They also asked that Mr. Hewitson provide some elevations, and provide them for each of the flags. Test pit E indicated hydric soils. Test pit A - D had been altered; there were varying amounts of fill. Aerial photographs were reviewed to compare '99 to most recent to see if there was an indication of activity on the site.
The photos were much different. Mr. Hewitson felt that other than new fill piles, the test sites had not been touched for a few years. The main problem is that there are fill piles in the wetlands that Mr. Hewitson flagged last year. There is one solution which is to pull the materials out, and establish some permanent monumentation, such as a fence. There is some concern between flags A and C, and ConComm is determining if they would like a trench dug through the middle of them.

7. Opening of a public hearing relative to the filing of a Request for Determination of Applicability for the South Street East Pump Station improvements project which includes the installation of an outdoor standby power generator and concrete pad, buried electrical conduits, relocation of approximately 24 feet of chain link fence, and installation of a new 2" gas service pipe and meter along the north side of the pump station to the generator. This sewage pump station serves the sewer system in the southeast portion of Raynham. The project location is 9 South Street East, Assessors' Map 17, Lot 151A, Raynham. The Request for Determination of Applicability is being submitted by the Board of Sewer Commissioners.
DISCUSSION:
Dave Prickett was here on behalf of the Board of Sewer Commissioners regarding an existing pump station, just north of the Taunton River, on South Street East, termed the South Street East pumping station, which was installed 15 years ago.
There is no back up power source, so, in the event of power outages, the sewer department goes out with a portable pump to ensure the wet well doesn't overflow. An outdoor emergency standby generator needs to be installed which will be powered by natural gas.
On the east side of the building, a concrete pad will be installed (which is the only pervious area being added) for the generator, which is 4 x 8-feet long, with a buried gas service from the street which is, approximately, 2 inches, to provide fuel to that tank. There are to be no oil tanks on the site. There will be a small 1-inch sampler line from the wet well to the pump station so the Town can monitor the waste water content.
A silt fence will be put up along the side. Fresh stone paving will be added inside the fence enclosure to match the existing landscaping.
Verbal communication has been done only between the Sewer Commission and any land owners nearby.
DECISION:
Set up a site visit via email correspondence to view the site, and see what can be put in for conditions for this; have permission slips signed by property owners that are there besides the Town; keep the parking by the river

Opening of a public hearing relative to the filing of a Request for Determination of Applicability for the construction of a cabana with associated landscaping and grading within 100 feet of a Bordering Vegetated Wetlands, at subdivision lot #11, 126 Brook Street, Map 16, Lot 7-11, Raynham. The Request for Determination of Applicability is being submitted by Dean and Irene Saxonis.
DISCUSSION:
Mark Coggeshall came in to represent Dean and Irene Saxonis. An RDA was submitted to build a cabana adjacent to a pool area.
DECISION:
There must be no activity closer than 50 feet, and the hay bale/siltation fence should be 50 feet back from the wetland.

9. Opening of a public hearing relative to the filing of a Notice of Intent for an after the fact NOI for a Wetland Restoration for an area of soil impacted by a gasoline release which was excavated from Bordering Vegetated Wetland and buffer zone. The area was backfilled with clean fill and topsoil. Native vegetation was planted according to a Wetland Restoration Plan at Route 24/King Street, Assessors' Map 12, Parcel 212 A6, Town of Raynham. The Notice of Intent is being submitted by Michael Lamarre, Exxon Refining and Supply Global remediation.
DISCUSSION:
The Commission should conduct a site visit to view everything that's happened, and everything that's out there, now. The applicants mentioned that there is monitoring going on of groundwater. There will be spring, summer, and fall monitoring of the wetlands, as well as the status of the plantings. Need to practice the growth progress on all plants in the spring, summer, and fall.
DECISION:
This will close on May 4 with the condition that a COC will not be done until growing has stopped, 75% or more of viable coverage, 3 cut growth if there is grass. The site visit will be organized via email; participants will meet on old King Street, go down the hill, and cross the brook to get to the location.

3. Discussion re: Borden Colony Lease Review
DISCUSSION:
The land is going to be re-leased. The Agent mentioned to the Town Administrator that ConComm would like to be a part of the process. She was shown a copy of the deed for the lease and remarked on it.
The Agent recommends sending a letter to the Board of Selectman that states that ConComm is interested in seeing through the lease review process, and all the interests that we are protecting will be upheld. David McRae was nominated to be the spokesperson on this for ConComm. David McRae accepted the nomination.

OTHER NOT ON THE AGENDA:
1. Jim Ross will be submitting a letter to step down from the Commission the end of June, ’06 or earlier if possible. He will be available to be an associate member. The Agent recommended submitting the letter, and asking Shelly Coelho, an interested party in joining the Commission, to come in to speak with the Commissioners on 4/20/06.
2. The Agent made all aware that the Fisher will be stuffed soon for the ConComm to be able to use for talking points in various meetings.
