FOR THE RECORD A QUORUM WAS NOT ACHIEVED, THE CONSERVATION COMMISSION HAD AN INFORMAL SESSION AND ASKED THAT MINUTES BE TAKEN AT THIS SESSION.
The Raynham Conservation Commission INFORMAL SESSION was called to order at 6:40 p.m.

SITE VISITS DISCUSSION:

REVIEW OF ANTINE MEMO MGL 39, SECTION 23D DISCUSSION:
The Agent asked the Commission to please revise so they can decide if they support it, or not. The Commission supported them memo. Agent was asked to communicate this to Mr. Buckner.

INFORMAL DISCUSSION WITH PUBLIC OPENED AT 6:40 p.m.
1. Discussion with regard to cutting on the corner of placeSouth Main and addressStreetKing Phillip Street
DISCUSSION:
John Noblin, Frank Campbell, and LeeAnn Bradley were present. The Commission explained to them that they were invited in due to an email that was received from a former ConComm member, Steve Cote, who was making them aware of areas being cut along the addressStreetSouth Main/King Phillip Street properties. LeeAnn stated that there is a section of a swale there that goes into the placePlaceNameForge PlaceTypeRiver, and vegetation inside has been cut presumably with a weedwacker. She mentioned that there is no bank disturbance. Mr. McRae asked if they could put up a couple of signs that states “No work” or something to that effect at the perimeter. .
Ms. Rochette stated that it looks like someone moved the stakes. Mr. Noblin explained that it has been reflagged by Walter Hewitson, and that is one of Walter’s new flags. The Agent stated if there is a report done by Walter it should be filed, and the flags should be put on a plan, and be submitted for an RDA, or an ANRAD. The Agent then explained the Commission’s submission policies and requirements for new filings.
2. Discussion involving Wildflower Green
DISCUSSION:
PersonNameJohn Schmid, Mike Jones (Can-Four), and Todd Unzedis (engineer) were present. Also, present were Mr. and Mrs. Randy Dyen, owners at Wildflower Green. PersonNameJohn Schmid gave an update on what the progress at Wildflower Green. Last time all met, the developer was to put the approved modifications into place. The construction of the detention basins are substantially complete. Basin 2 needs more vegetation to be stabilized. Basin 3 and 4 have been stabilized well. He went on to say that the as builts were reviewed and they indicated that the construction condition, the elevations, were a little bit off from the design condition. Todd was asked to rerun the drainage analysis with the as built condition.
The Agent stated that they would continue to use Mr. Schmid. He gave a new estimate, and new cost analysis, because this will not be done until they receive a three cut growth. They will continue to do some inspections, and try to close this out in the spring, assuming that they can still get the consultant’s paperwork.
Mr. Schmid responded that in Basin B2 the grass is coming in, and there are no signs of any erosion. It was asked that some modifications be made to the outlet structure where there were signs of erosion last week. The fence, gate, and enclosure all went in.
Ms. Rochette asked if we have anything from Mike Jones stating that after they have sold 75 – 100% of the units they will stay with the project until a Certificate of Compliance has been acheieved. Mr. Jones stated that everything is in their name, and they can write a letter stating that they will remain with the project until a Certificate of Compliance has been achieved. Ms. Rochette agreed to have Can-Four write that letter. The Agent stated that she would give the Dyen’s a copy of this letter. Mr. Jones stated that they would comply with the conditions of the permit, and maintain it, as necessary. The Agent added they would do that until the final COC has been achieved.
Mr. Schmid stated that he received as built plans, and they are acceptable, but they need to be stamped because they were received electronically.
Mr. Schmid, also, stated that if we receive a substantial rainfall of 6-7 inches, then, a site visit should be conducted to see if there is erosion. Also, in the spring, when the snowmelts, and the grass comes, another site visit should be conducted to see if there are any more issues.
Mr. Dyen stated that he lives behind Basin A4 and he is representing five other owners, and they are all unhappy with the condition of this basin. He was surprised that it was not mentioned that there is standing water in that basin all the time. Mr. Schmid responded that there would always be water in that basin. He mentioned that if we have a dry summer, then, it should infiltrate; if we have a wet fall, the water will hold. He went on to say that within a year or two, vegetation in the basin should grow. Mr. McRae stated that recharge means that there will always be a certain amount of standing water there. Mr. Schmid stated that storm water management, and retention design, is not an exact science. There are, also, standard engineering practices, which were used. The Agent
stated that there are two standards here, recharge, and the amount of time to recharge. A dry basin means there is no recharge, and to make a dry basin goes against the storm water management in placeStateMassachusetts, which they cannot do.
The Agent stated that this is a progress report tonight. Plants need to grow, and the system needs to adjust. No Certificate of Compliance is being issued or requested tonight.

Opening of a public hearing relative to the filing of a Notice of Intent under the Wetlands Protection Act, Mass. G.L. Chapter 131, Section 40. The Notice of Intent is being submitted for the construction of driveway aprons, utility connections and service lines, one storm water drainage system. The installation of a water main on Mill Street, 150 +/- of roadway with associated grading, five foot sidewalks, handicap ramps, and curbing; and associated erosion control measures within the 100 foot buffer zone to a Bordering Vegetated Wetland, and two hundred foot river protection zone as applicable. The proposed project is located at PersonNameAssessors’ Map 8, Lot 225 Mill Street, Town of Raynham. The Notice of Intent is being submitted by Alice Gonsalves.

Opening of a public hearing relative to the filing of a Notice of Intent for the construction of a single family home with associated driveway, grading, fence, utilities within 100 feet of existing wetlands and a previously approved restoration area for Map 3, Lot(s) 460, 461, 189 Overlook Drive, Town of Raynham. The Notice of Intent is being submitted by Steve Parker.
DISCUSSION:
Continued until 1/4/07.
