FINAL MINUTES FOR THE RAYNHAM ROUTE 138 ZONING STUDY COMMITTEE MEETING ON OCTOBER 2, 2006



The meeting of the Raynham Route 138 Zoning Study Committee was called to order at 5:24 p.m.

2.      Discussion of letters of interest received for opening on Committee/Vote for recommendation to Business and Economic Development Committee

DISCUSSION:
Mr. Pacheco stated that one letter of interest to be on the Committee was received.  It is from Carla McRae.

4.      Discussion re:  Draft revisions to Designated Development District of the current Zoning Bylaws with Help Raynham

DISCUSSION:
        Per Tony Ghelfi, there are no updates.


5.              Discussion of Table of Use Requirements

DISCUSSION:
Ms. Ueberbacher stated that the Committee will have to decide how to proceed with the Route 138 Study and review process.  The Committee needs to decide if it should edit the Designated Development District in our current zoning bylaws; Articles 4 and 6.  To date, the Committee has been working with Help Raynham on proposed changes to the Zoning Bylaws.  Mr. Pacheco stated that our direction has been working with Help Raynham, and they have decided to work on it until May.  This leaves the Committee, and Help Raynham, at a crossroads.  He questioned whether the Committee, in the time in between a new presentation from Help Raynham, and the May Town meeting, would want to start editing the current uses, Section 4 and Section 6, or go ahead with Section 4 and 6 as is, or stay the course with Help Raynham.  Ms. Ueberbacher stated that there shouldn’t be any redundancy on the Town Meeting floor, and, if Help Raynham and Route 138 could come to a consensus on any revisions, it would be helpful. Mr. Ghelfi responded that Help Raynham is still looking at how to define the areas.  He stated that he could send via email the zoning bylaw edits Help Raynham has been working on, and at the next meeting it could be reviewed by everyone.  The options at present are to pursue revisions to Article 4 and 6, make no revisions, or stick with the Help Raynham revisions.  Mr. Pacheco stated that the next meeting will be a joint meeting with Economic and Business Development, and it would be a good time to receive some initial feedback from them.  Mr. Bousquet requested that a copy of the changes, also, be provided to Economic and Business Development so that they may review the edits prior to the meeting.
Mr. Pacheco asked where the table of use fits in with where Rt. 138 is right now.  Mr. Guimond stated that Article 4 is where any revisions to the table of use could be inserted.


6.              Sewer/Water Usage Discussion

DISCUSSION:
Ms. Ueberbacher stated that the agreement with Taunton, the IMA, was signed.  Mr. Pacheco added that this IMA is similar to the old one in that any unused capacity per day would be available to the Town; currently the agreement was made for 1.3 million gallons a day.
Mr. Bousquet stated that you cannot anticipate what is going to come into Town, or what they are going to use.  Ms. Ueberbacher thought maybe you could base sewer usage on water usage, but, then, you do not know how much is being reused, or how much of it is going out.  She cited an example of if Johnson & Johnson uses “x” amount, then a similar business could use the same “x” amount.  Mr. Pacheco, further, clarified that if Johnson & Johnson uses 9.5 million gallons of water, there is a 28,500-sewer usage charge.  He stated that, right now, Johnson & Johnson is the biggest water user, the Dog Track is number two, and the Hampton Inn is number eleven, according to the table of uses.


7.              Update on Grant from Richard McCarthy

DISCUSSION:
Mr. Guimond stated that they put in for a grant to help fund the Route 138 Committee almost a year ago.  All have all been reviewed and scored.  A decision was supposed to be made before the next Route 138 meeting.  Mr. McCarthy should have an update by the 10/16 meeting.

9.              Community Input

DISCUSSION:
The owner of the Route 138 Auto Mall, Robert Paxeinho, attended the meeting.  He stated that he bought his business under “business district”, and understands that now it is under “office development”.  He stated that this impacts him.  He was made aware by the Committee that they were a study group and no changes have been made thus far.  Therefore, he is still in a business district. He was informed that this was a study group and that no changes have been recommended and may not be recommended depending on the outcome of the study.  He was told that the meetings are posted on the website, and that they are open to the public.  Lastly, he was shown a map of the study area.
Mr. Paxeinho stated that half of his property is in Raynham, and the other half is in Taunton
Mr. Guimond informed him that if any changes had been proposed through Taunton that they post changes in the newspapers twice in fourteen days. Raynham has a different process in that there is a town meeting vote that determines whether or not any zoning changes will be upheld.

Tony Ghelfi to email to the Committee and to Economic and Business Development the Help Raynham revisions to the zoning bylaw.
