February 27, 2007 BOARD OF SELECTMEN
Chairman Donald L. McKinnon called the regular meeting of the Raynham Board of Selectmen to
order at 7:00pm.
Present were Donald L. McKinnon, Raymond W. Platt, and John Donahue.
Mr. Platt motioned and Mr. Donahue seconded to accept the minutes of the February 20, 2007
Meeting as printed. Mr. McKinnon made it unanimous.
Mr. Bettencourt was present and updated the Board on the completion of the new Town Hall/Sullivan School. Mr. Bettencourt presented the Board with a memo from the Raynham Permanent Building Committee informing of the completion of the Town Hall along with a recommendation for a definite program for maintenance of the building. Mr. Bettencourt thanked all members of the Raynham Permanent Building Committee. The Board members thanked Mr. Bettencourt and his Committee and commended them on a job well done
7:10pm–Theresa Medeiros, Re: Land Taking off of Leonard St. pursuant to MGL, Chapter 79, Section 5B. Mr. Stolte and David Law presented and discussed plans for a storm-water detention pond on the Medeiros Family property. Mr. Stolte stated the land is agricultural and that the area is still being farmed. Mr. McKinnon asked if research was performed on other areas. Mr. Stolte confirmed that they have researched the area and deemed this to be the most viable area for the drainage. Mr. Law, from Tighe and Bond, explained MGL, Chapter 79, Section 5B and informed that a survey was performed on different pieces of property, but the gravity needed for the project was not available. Mr. Stolte said that the pond would be fenced and that the drainage system is needed for the future
re-construction of Leonard Street. Mrs. Medeiros was present and stated that her father-in-law, then her husband, had farmed the land and now her son. Mrs. Medeiros stated that the construction of the detention pond would limit the use of their land for the future. Mike Medeiros presented the Board with a copy of the law and stated that the family is registered with the Farm Bureau Federation. Mr. Medeiros stated that the system, in his opinion, would not work in the proposed area and suggested a plan of action to replace the proposed area.
Mr. Medeiros stated that he does grow hay and has cows on the property. Mr. Medeiros said that the portion of land, which will be used for the pond, would not allow him to graze cows. Bill Nickerson was present and stated that the proposed site for the drainage system would impact the Medeiros Family livelihood and that the proposed site is not the sole avenue for the drain. Larry Perry a Leonard Street resident was present, and stated that a metal fence in the middle of farmland in the Town of Raynham would be a shame. Mr. Perry also expressed his concerns with mosquitoes around the pond. Mr. Platt stated that he would like to see Mr. Law and Mr. Stolte pursue every option and recommended tabling the discussion for one month. Mr. Platt motioned and Mr. Donahue seconded to table
discussion for the proposed drainage for one month. Mr. McKinnon made it unanimous.
7:50pm – Board of Assessors, Hearing on Classification of Real & Personal Property. Mr. Lewis, Mr. Lalli, Mr. Luciano presented the Board with a slide show presentation for 2007. The Board of Assessors presented an overview of all figures and informed all that 2007 was the three-year re-val year.
The Board of Assessors supplied the Board with four options for a shift.
Mr. Buckner’s Town Administrators Report was reviewed
Mr. Platt motioned and Mr. Donahue seconded to cancel the scheduled Public Hearing for applicants for Wine & Beer License from March 13, 2007 and to re-schedule to March 20, 2007. Mr. McKinnon made it unanimous. Mr. McKinnon said that the present applicants are Tip Top Seafood, and Grand China Buffet.
Mr. Donahue informed all that the Board was present during last Friday’s meeting with Lt. Gov. Murray regarding discussion of the future of the train. Mr. Donahue requested that Mr. McCarthy perform a study of aspects involved in the train and the impact it would have on Raynham. Mr. Donahue motioned and Mr. Platt seconded to request Mr. McCarthy perform a study of the impact the train would have on Raynham. Mr. McKinnon made it unanimous.
Mr. McKinnon suggested scheduling a meeting with residents to discuss the train.
Correspondence – The Board received from the Highway Department a request to exceed its snow and ice funds due to exceeding the $50,000 budget. Mr. Platt motioned and Mr. Donahue seconded to approve the request from the Highway Department. Mr. McKinnon made it unanimous.
Correspondence - The Board received an application for Constable from Duane L. Mitchell. Mr. Platt motioned and Mr. Donahue seconded to approve the application for Constable from Duane L. Mitchell, P.O. Box 68. Mr. McKinnon made it unanimous.
Correspondence - The Board received a request for an acceptance of roadway from Mike Gomes of Elmwood Estates. Mr. Platt motioned and Mr. Donahue seconded to forward the request to the Planning Board for a recommendation. Mr. McKinnon made it unanimous.
Corresponence - The Board received from the Raynham King Philips Lions Club a request for a One Day All Alcoholic License in order to sponsor spaghetti on March 31, 2007, 6-9pm. Mr. Platt motioned and Mr. Donahue seconded to approve the request for the Raynham King Philips Lions Club for a One Day All Alcoholic License March 31, 2007, 6-9pm. Mr. McKinnon made it unanimous.
Correspondence – The Board received requests for Tag Days as follows: Cub Scout Pack 20 of Middleboro for March 11, 2007 to sell candy bars; Disabled Veterans, Forget-Me-Knots on August 24, September 20 & 23, 2007. Mr. Platt motioned and Mr. Donahue seconded to approve the above listed Tag Days. Mr. McKinnon made it unanimous.
9:11pm – Mr. Platt motioned and Mr. Donahue seconded to adjourn for the performance of administrative duties, signing Bills and Warrants and to go into Executive Session re: Litigations with no business to be conducted afterwards. Mr. McKinnon made it unanimous.
