Board of Selectmen Minutes 05/22/2007
May 22, 2007                                                              BOARD OF SELECTMEN

Chairman John Donahue called the regular meeting of the Raynham Board of Selectmen to
order at 6:05pm.

Present were John Donahue, Donald L. McKinnon, and Joseph Pacheco.

Mr. Donahue informed all that the Board was returning from an Executive Session regarding Litigation.

Mr. McKinnon motioned and Mr. Pacheco seconded to accept the minutes of May 15, 2007 meeting as printed. Mr. Donahue made it unanimous.

Chief Pacheco was present and informed that a demonstration was given this week on a traffic control devise and would like to invite residents to attend a Board of Selectmen meeting on June 12, 2007 to learn more about the devise.

Mr. Donahue informed all that there were five (5) members of the local Boys Scout Troop present who were working toward their Citizenship Badge.

Mr. McKinnon motioned and Mr. Pacheco seconded to reappoint Attorney Marc Antine as Town Counsel.  Mr. Donahue made it unanimous.

Mr. Donahue discussed the Town Meeting vote late night regarding the acceptance of an override.  He said that a ballot vote would be needed to approve $874,000 for the School District.  
Mr. McKinnon motioned and Mr. Pacheco seconded to schedule a Special Town Election for the override on Saturday, June 30, 2007.  Mr. Donahue made it unanimous.
Mr. McKinnon motioned and Mr. Pacheco seconded to request that Mr. Buckner speak to Attorney Antine regarding the ballot question.  Mr. Donahue made it unanimous.

Mr. Buckner’s Town Administrator’s Report was reviewed

Mr. Donahue informed all that the Board has received a package from MMA regarding the Municipal Partnership Act: Advisory Kit.  The Board agreed to discuss the different plans and its affects next week.

7:15pm – Public Hearing, Raynham Wine & Liquors, Broadway Market, Westborough Beverage (Wal Mart) on whether to modify, suspend, revoke or cancel the Alcoholic Beverage License for alleged serving to minors.  Present for Raynham Wine & Liquors was Bernie Carp & Richie Maher, for Broadway Market was George & Michael Confoey, and for Wal Mart was Bert Cabral.  Chief Pacheco was present with the individual who went undercover to the establishments for the Town.  Chief Pacheco informed that on April 27, 2007, an initial investigation was conducted where three out of six establishments did not require an ID to purchase liquor.  Chief informed that after an Executive Session with the members of the Board, a second investigation was conducted with the same three establishments who were in violation of the law.  Chief stated that upon the second investigation, Wal Mart requested an ID for the purchase of alcohol whereas Raynham Wine & Liquors and Broadway Market did not.  Chief Pacheco informed all of the standards for the investigation and the undercover appearance.  Board members asked the undercover individual if all standards were met under the criteria of the investigation.  The undercover individual agreed it was.  

Mr. Cabral of Wal Mart agreed that the sale of alcohol did occur at 5:33 on said date at register 10.  
Mr. Cabral said that the employee was ID’d and terminated after an investigation was done internally.  Mr. Cabral apologized to the Town, Board of Selectmen and the community and stated that Wal Mart has a high standard set with zero tolerance.  Mr. Cabral assured the Board that it will not happen again and stated that out of 96 cashiers, 5 on leave of absence, 91 have been retrained on the sale of alcohol with each employee signing Wal Mart’s Procedure & Policy statement.

Mr. Carp of Raynham Wine & Liquors stated that they are embarrassed and ashamed for the serving to a minor.  He stated that they do no cater to young individuals in any form; they truly care about the community. He state that they contribute to the Town and are active on the State level for helping to control the sale of alcohol to minors.  Mr. Carp apologized to the community, Board of Selectmen and Chief for the recent sale of alcohol to a minor.  He stated that he intends to correct the problem by installing ID scanners on each register.  He stated that each employee was instructed to ID any individual who may look under the age of 40.  He further informed the Board that employees have reviewed and signed the updated procedures for the store and that all employees will be certified by a server-training course, which they will attend within the next 90 days.  Mr. Carp stated that a secret shopper program would also be implemented.  

Mr. Confoey of Broadway Market apologized to the Board, Chief Pacheco and the community for their recent action in the sale of alcohol to a minor.   He concurred that the sale of alcohol to a minor did occur twice at his establishment.  He informed the Board that the store policy has been revised to ID any individual who does not look like a senior citizen.  Mr. Confoey stated that each employee have received and signed a revised store policies.  He further stated that the store is looking into data base material to interface with present registers for identifying an individual’s date of birth.
Chief Pacheco stated that over the past three years, each establishment has been outstanding.
Mr. McKinnon asked Mr. Cabral if there was a different cashier involved during the second investigation.  Mr. Cabral informed that it was.  
Mr. McKinnon motioned and Mr. Pacheco seconded to request letters of thanks be sent to the individuals at Wal Mart and the three establishments who have adhered to the law by asking for ID’s.  Mr. Donahue made it unanimous.
Mr. Pacheco stated that the establishments who sold liquor without proper identification should be ashamed of their action and stated that in the future if any of these establishments are in front of the Board for a similar situation, he would recommend the extreme of punishments to each.  
Mr. Donahue said it was very disappointing to see these establishments selling without properly identifying individuals.  Mr. Cabral stated that they could not have just one designated register for the sale of alcohol as they do for cigarettes.  Mr. Donahue requested that the three establishments be monitored as frequently needed and deemed by Chief Pacheco.  
Chief Pacheco asked for the Board’s permission to expand his investigation to sit-down establishments.  Mr. McKinnon motioned and Mr. Pacheco seconded to approve the expansion of undercover investigations for serving of alcohol to sit-down establishments.  Mr. Donahue made it unanimous.
Mr. McKinnon motioned and Mr. Pacheco seconded to suspend Wal Mart alcoholic beverage sales for one day, May 29, 2007; suspend Raynham Wine & Liquors and Broadway Market alcoholic beverage sales for two days, May 29 & 30, 2007.  Mr. Donahue made it unanimous.
7:47pm - Mr. McKinnon motioned and Mr. Pacheco seconded to close the Public Hearing.  Mr. Donahue made it unanimous.

Mr. Donahue requested that Mr. Buckner report back to the Board on the professional up-keep of the new Town Hall and the coordination of the normal guarantees given to the Town for the building.  
Mr. McKinnon motioned and Mr. Pacheco seconded for a report from Mr. Buckner on the new Town Hall maintenance.  Mr. Donahue made it unanimous.

Mr. Donahue gave a brief update of the Town Meeting held last night and especially thanked Moderator Tripp and Attorney Antine.  Mr. Donahue informed all that the vote for the override was passed that he was in support of the override.

Mr. McKinnon thanked all who attended the Town Meeting last night and thanked especially the Parent Groups, RAVE and School Committee.  Mr. McKinnon concurred with Mr. Donahue on the support of the override.

Mr. Pacheco also concurred with Board members in the support of the override.

Correspondence – The Board received from the Highway Department a request to approve the appointment of Courtney Saunders to the vacant Highway Department position.  Mr. Stolte said that Ms. Saunders has been employed by the Highway Department for the past six months; therefore, a probation period would not be necessary for Ms. Saunders.  Mr. McKinnon motioned and Mr. Pacheco seconded to appoint Courtney Saunders to the vacant position in the Highway Department.  Mr. Donahue made it unanimous.

Correspondence – The Board received from Robert Bell of Forge River Parkway a request for speed bumps to be installed for safety purposes.  Mr. McKinnon motioned and Mr. Pacheco seconded to forward the request to the Chief Pacheco and Mr. Stolte.  Mr. Donahue made it unanimous.

Correspondence – The Board received from the Planning Board a request to authorize the approval of engineering survey plans for the construction of a multi-use path on Elm Street East, funding of which came from the Wildflower Development.  Mr. McKinnon motioned and Mr. Pacheco seconded to forward the contract to Attorney Antine for review.  Mr. Donahue made it unanimous.

Correspondence – The Board received request for tag days as follows:  Taunton Youth Soccer League on September 7, 8, 9, 2007 and Taunton School Department Extended Day Program for a car wash on May 26, 2007.  Mr. McKinnon motioned and Mr. Pacheco seconded to approve the tag days as listed pending approve from the water district.  Mr. Donahue made it unanimous.

8:31pm – Mr. McKinnon motioned and Mr. Pacheco seconded to adjourn for the performance of administrative duties, signing Bills and Warrants, with no business to be conducted afterwards.
