Board of Selectmen Minutes 03/17/2009
March 17, 2009                                                  BOARD OF SELECTMEN

Chairmen Joseph Pacheco called the regular meeting of the Raynham Board of Selectmen to order at 7:02pm.

Present were Joseph Pacheco, Donald L. McKinnon and Marie Smith.

Mr. McKinnon motioned and Mrs. Smith seconded to accept the minutes of the March 10, 2009 meeting as printed.  The vote made unanimous

John McGarry, Veteran Memorial Committee Chairman, was present with Committee Members to honor 2nd Lt. James McGarry who was killed in Vietnam.  Mr. McGarry read the many accomplishments and honors received by 2nd Lt. McGarry.  A plaque/street sign in honor of 2nd. Lt. McGarry was present for viewing.  Mr. McGarry requested the sign be erected on the corner of Church Street and Rt. 44, the neighborhood where 2nd Lt. McGarry grew up.  Mr. McKinnon motioned and Mrs. Smith seconded to approve the request for the street sign to be erected at the corner of Church St./Rt. 44 by the Highway Department.  Mr. Pacheco made it unanimous.  
Frank McGarry was present and congratulated the Town and Board Members for their decision to honor his brother and the many young men and women who served our country.  

Mr. Pacheco recommended the re-appointment of Attorney Marc Antine for Town Counsel.  Mr. McKinnon motioned and Mrs. Smith seconded to appoint Attorney Marc Antine as Raynham’s Town Counsel for a period of one year.  Mr. Pacheco made it unanimous.

The Board received from Judith Niles, chairman of the Raynham Cultural Council, a recommendation to appoint Debbie Silva, Kellie Kelleher and Marilyn D’Andrea to the Cultural Committee.  Mr. McKinnon motioned and Mrs. Smith seconded to appoint Debbie Silva, Kellie Kelleher and Marilyn D’Andrea to the Cultural Committee as of April 1, 2009.  Mr. Pacheco made it unanimous.

Mr. Pacheco informed all that the appointment of Animal Inspector was due and that Sarah Krajewski had volunteered to continue in that role.  Mr. McKinnon motioned and Mrs. Smith seconded to re-nominate Sarah Krajewski as Animal Inspector for one year.  Mr. Pacheco made it unanimous. The nomination will be sent to the State for final approval.

7:20pm-Public Hearing – Quan Am Market LLC dba Broadway Market all-alcoholic beverage package store license for 855 Broadway.
Present was Mr. Dang, present owner of Broadway Market and Attorney Mark Deschane.  The Board was informed that at present, Broadway Market has a beer and wine license, which will be surrendered when the approval/transfer of the all-alcoholic package store license is finalized.  Mr. Buckner stated that there have been no incidents reported at 855 Broadway.  Mrs. Smith asked if there would be any change in the market.  Mr. Dang said there would be no change and that he would continue to sell groceries.  Mr. Pacheco reminded the applicant that the Town of Raynham took the sale of alcohol to minors very seriously.  
Mr. McKinnon motioned and Mrs. Smith seconded to approve the transfer of an all-alcoholic beverage package store license for Quan Am Market, LLC d/b/a Broadway Market at 855 Broadway.  Mr. Pacheco made it unanimous.

Mr. Buckner’s Town Administrator’s Report was reviewed.

Mr. McKinnon reminded all that the May Town Meeting is just a short time away and of his requests for two articles to be placed on the Warrant: snow removal and unlicensed vehicles.

Mr. Pacheco advised all that on Sunday, March 22, 2009 the Move Over Law takes effect.

Mr. Pacheco asked that representatives entering into negotiations with the different Unions in Town put forth the request of zero percent increase in base salary for FY10.  Mr. McKinnon motioned and Mrs. Smith seconded to request zero percent increase in base salary for FY10 from the different Unions in Town.  Mr. Pacheco made it unanimous.

Correspondence – The Board received from Briarwood Construction Corp. a request for modification of the fee for a building permit for 30 Homestead Drive – Carriage Hill Estates.  Building Commissioner Ed Gardner recommended approval of a pro-rated fee. Mr. McKinnon motioned and Mrs. Smith seconded to approve the request as recommended.  Mr. Pacheco made it unanimous.

Correspondence – The Board received from the Lt. Governor an update on the Federal American Recovery & Reinvestment Act (Federal Stimulus Bill).

Correspondence – The Board received a copy of the ruling by Judge Cosgrove regarding the Market Basket suit (DeMoulas/Wal Mart case). The judge ruled in favor the Raynham Planning Board and dismissed DeMoulas’s suit.

Correspondence – The Board received from Attorney Antine information regarding the recording of the Order of Taking for the relocation of Thrasher Street.

Correspondence – The Board received the following requests for Tag Days:  “Freeze” Girls 16 and under Travel Softball for March 28 & 29, 2009; Brenda Abbott of the Bristol Agricultural High School for May 23, 2009; Daisy Troop 80476 for March 30, 2009; Silver City Skateland for May 10, 2009; and Fun Faces with a Twist for May 24, 2009.  Mr. McKinnon motioned and Mrs. Smith seconded to approve the above listed Tag Days.  Mr. Pacheco made it unanimous.

7:38pm – Mr. McKinnon motioned and Mrs. Smith seconded to adjourn for the performance of administrative duties, signing Bills and Warrants with no business to be conducted afterwards.  
Mr. Pacheco made it unanimous.
